Should I pay my rent or mortgage? Please read the explanation…?

I live in Dallas, TX and I am paying rent in the amount of $514.00 per month on an efficiency apartment. Yet I also have a mortgage for $496.00 per month on my home out of state. Well, for various reason (it’s complicated) I will have to decide which one to pay “on time”. Because this is Texas the law allows the apartment complex to charge up to $200 to $500 on late fees starting at $75.00 after the first day and $10.00 each additional day.

But a late mortgage would only cost me $30.00 plus a late on my credit report.

I have paid my mortgage on time for a year but I am getting ready to file bankruptcy so my credit (already ruined) will be ruined for an additional 7 years so I am thinking its best to pay the mortgage late as I will have the money next month.

Please advise on what I should do. Your assistance is greatly appreciated.

Why is the other house empty? That should be rented out if you are in TX. Ahwell, pay late on the mortgage if you think late is all it’s gonna be. If it’s gonna look like a default then default on the rent, when you go bankrupt they won’t be able to get the money from you anyway

I will be over 30 days late on my mortgage but only about 12 days late on my rent. And yes. ALL the companies in Texas are allowed to charge $75 dollar after the first day late PLUS an additional $10 dollars each additoional day till you pay and that is how the legislature in Texas wrote the law. They can charge an unlimited amount of late fees and they do. I have friends who only pay around $400 per month in rent but have to pay up to $400 in late fees. It is allowed by the law here. They all do it.

You need a place to live, so pay the rent. Your credit will be trashed when you file BK and that will stay on your report for 10 years.

A late mortgage payment is a minor issue compared to the impact of bankruptcy. This is only the beginning of your money problems.

Is there such a thing as a professional apartment hunter ?

I see real estate agents for homes and condos, but what if you want someone to look for an apartment for you. There are so many apartments and apartment complexes that it becomes confusing and would take so much time and gas to check out each apartment you look up on line. I have checked on line, but do not see any listings for apartment hunters. I have just put in “Apartment hunters” on line, but it just takes me to sites like “Rent.com” or real estate agents for homes. I live in the Dallas, Tx area. Thank you for any suggestions.

Real Estate Agents also find apartments for their customers. The person that owns the apartment will pay your realtor and their realtor, so you don’t pay anyone anything. Only problem is if the apartment owner only has a “for rent sign” in the window and they didn’t hire a realtor, your realtor will never find it, in that case you will just have to walk around and find it yourself.

Why do I have to go through the owner instead of leasing office to rent a condo?

This would be my very first place and very first condo, obviously i’m an amateur on knowing how to rent a condo since it’s a bit different than renting an apartment. Well I’m not ready to move out yet but am Instead apartment hunting to see where I want to move to, so far I found this condo and two other areas but am more interested in the condo due to it having a stacked W/D and that H.O.A pays the water bill. so all I would be paying for is the rent and electricity (as well as any other services I get). When I called the leasing office about the floor plan I liked (due to it being the most affordable and other reasons). she told me that I would have to talk to the owner of that particular condo floor plan, which confused me a bit because why would I have to speak to the owner who’s renting the condo, if that owner was also a renter who moved out? am I missing something with this, is it even legal for that too happen? How does a person rent out a condo exactly, what do I need to be aware of and or ask? Like I said this will be my first own place and it will just be me living there, also does anyone know what Biangular LLc is? it was the guys email I spoke to about the condo and he sent me some links through email to see pictures of the inside of the condo, he has this asian like name too. thanks so much guys for you’re help.

He also said that he’s willing to accept me paying 2/3 months of rent if I still haven’t found a job yet and am looking to move out (emergency move-ins, i guess). He seemed very calm and not so cautious about me wanting to move there, I mean I barely can find any reviews about the place and the outside of the condos looks very old, it was made in the 70′s and the outside is grayish looking. Hopefully it’s not a bad place, if so then I’m not moving there, I value safety and security when moving to an area, also since it’s only going to be me and no one else there (unless god’s plan on living on my own is for someone to live with me).
heres links to pictures of the place, what do you guys think and like I said what do I need to ask, look out for and be aware of when renting a condo? would I be able to change the wall coloring or any other things in the condo?

I also was told by the leasing office the there are 60 owners of the condos, is that ok to have that many and what is an H.O.A? do I need it?

The questions are funny, but you do need to know the answers. Condos are usually individually owned, just like houses are, so the unit you want to rent is privately owned and not managed by the office you spoke with.

Some businesses are LLCs, which simply stands for limited liability company – it may or may not hold title to the property, probably is just a business name the owner has.

HOA stands for homeowners association – you don’t have a choice, anyone residing in a condo must adhere to the rules of the HOA. In almost all cases, the monthly dues are paid by the owner and are included in your rent price, but you might want to check to make sure.

You will NOT be able to change anything inside the condo without the express WRITTEN permission of your landlord.

can a londlord send a constable to escort me off the property?

I have stayed at this apartment in Dallas, TX for 3 months and i am a month behind last week the landlord gave me a hand written letter stating that either i pay 200 dollars or move out and today the landlord told me that a constable will come tomorrow and escort me and my family off the property and they will put are stuff in front of the house, can that happen even if we where only ordered by the land lord and not court?

In most states you have to go to court first, and my understanding is that is the case in TX as well, although they have an expedited system
PAY your rent! You promised to pay it in full and on time. Your first obligation to your family is keeping a roof over their heads
ASK family for help, go to your church for help, to township or county
