is an insurance settlement considered income?

If my 2 year old son receives a $10,000 payment for a dogbite, is it considered income. We live in an income based apartment and want to know if our rent will be capped out. This money is supposed to be a good thing, but if our rent gets capped out,and we cannot afford the difference with our income, we will have to use some of the $10,000 on rent and not be able to invest it for our son?

Administrator answers:

You won’t be able to use any of that money for rent. Period

With a settlement amount that large, odds are the insurance company is going to be required to have the settlement court approved. The court will require the money be held until the child’s 18 birthday.

It’s not your money.

You can’t use it to pay for rent. You can’t buy a car with it. You can’t buy a washing machine. The court will require the money be held in trust until your son turns 18. You don’t get to spend any of it. It does not belong to “we” – it does not belong to “you” – it belongs to your son only.

We can’t tell you if the money will be considered in your rent. That’s something you need to speak to your apartment manager about.

Do you mean you’re thinking about LIVING in an apartment? If its listed as “based on income” it likely means the apartment owner/manager/landlord is going to be looking at the applicants income as a primary consideration for who is selected.

You need to call/visit your local housing authority.

If you qualify, be prepared to be put on the bottom of a very long waiting list of 3-5 years.

calling about a based on income apartment?

My boyfriend and I are trying to get into a low income apartment. We turned in the application about three weeks ago. I wasn’t with him when he turned it in because I was at work. That is why we need it because he has lost his job and like everyone else right now we are struggling. Would it be stupid to call this apartment complex since we are on a waiting list? I just really wanted to know if we are on the waiting list and if we are, how long it will take before we get an apartment. I just didn’t know if you called to talk to managers at apartments with housing assistance since I am sure they have many applicants right now.

Depending on where you live, the waiting list could be many months, if not years long. It’s does not hurt to call and see where you name stands on their list.

How fast will I be able to find one wit three to four bed rooms.

Administrator answers:

Call your local welfare, HUD, or section 8 office.

You are going to find waiting lists that are years long.

In other words you are not going to be moving in to a low income apartment anytime soon.
